“Woman Advocates for Power of Attorney After Husband’s Hospital Struggle”

Dorothy Cook dedicated herself to caring for her husband, Melvin, for almost five decades after he was diagnosed with a rare brain condition. However, she encountered a challenge when a doctor refused to release him from the hospital due to the absence of a power of attorney document.

Power of attorney is a legal instrument that authorizes a trusted individual to make financial, property, or healthcare decisions on behalf of another person. Dorothy, a 68-year-old from Bristol, transitioned from a successful career as an occupational psychologist to a full-time caregiver for Melvin, who suffered from ataxia, a progressive brain disorder affecting movement and communication.

During a hospital stay in March 2025, a doctor deemed Melvin lacking mental capacity, preventing his discharge. Dorothy believed this assessment stemmed from Melvin’s communication difficulties rather than cognitive impairment, but her absence at the evaluation hindered clarifying the situation.

Despite caring for Melvin for several years, Dorothy had to demonstrate her capability to continue his care for the hospital to discharge him. Failure to do so would have allowed the hospital team to intervene legally. Melvin, a former engineer involved in Concorde’s design, exhibited ataxia symptoms 17 years ago, prompting Dorothy to become his full-time caregiver as his health declined.

Melvin passed away at 78 in June 2025, prompting Dorothy to share her experience on the inaugural Power of Attorney Day to enhance awareness of this essential legal document. She emphasized the challenges they faced due to the lack of a power of attorney and encouraged others to proactively establish one.

Various organizations, including Carers UK and Standard Life, collaborated to launch the UK-wide Power of Attorney Day, aiming to address the low rate of adults with updated power of attorney arrangements. Despite its importance, less than half of individuals prioritize establishing power of attorney, even as they age.

Helen Walker, Carers UK’s Chief Executive, stressed the significance of preparing for unforeseen circumstances through power of attorney. Similarly, Claire Hawkins, Standard Life’s Director of Corporate Affairs, highlighted the document’s critical role in safeguarding individuals and their financial management in times of crisis.

The initiative aims to ease the burden on caregivers and ensure individuals’ preferences are respected, ultimately reducing stress and anxiety both presently and in the future.
