“Arrogant Driver Smirks Before Tearful Sentencing for Fatal Crash”

Caught on camera, a driver, now labeled as “arrogant,” displayed a smirk outside court before breaking down in tears over his jail sentence for causing the death of a young woman.

Dean Tolan, aged 36, was captured on film at Sheffield Crown Court awaiting sentencing after admitting guilt in the death of Ellie Smart, 29, due to dangerous driving. The footage revealed Tolan seemingly using his hands-free phone function while smirking.

Before entering the court, Tolan was seen engaging in light-hearted conversation with others and carrying a large overnight bag. However, his demeanor shifted to tears as he received a nine-year sentence for the tragic accident in Sheffield, South Yorkshire, occurring on January 25, 2024.

Tolan has been disqualified from driving for a decade. It was disclosed that besides exceeding the speed limit at 58 miles per hour when colliding with Ms. Shaw as she crossed the road, Tolan was also not wearing his required glasses, a condition of his driving license.

Judge Jeremy Richardson KC condemned Tolan, a resident of Sheffield, South Yorkshire, for his “flagrant disregard and arrogance” towards regulations. The court was informed that Tolan had also been using his phone just moments before the incident.

In a poignant statement to the court, the grieving parents of Ms. Smart expressed their devastation at witnessing their daughter’s passing shortly after the January 2024 crash. Ms. Smart, a distinguished communications graduate employed in the press office of South Yorkshire Police, had visited them on the day of the tragic event.

Living close by, her parents shared their heartbreak at the realization that she would never experience marriage, have a family of her own, or witness her niece’s growth.

Prosecutor Laura Marshall highlighted that Tolan disregarded his driving license restriction by not wearing glasses during the collision, despite the requirement for corrective eyewear. Tolan failed multiple eyesight tests at the scene and falsely claimed to have noticed vision issues shortly before the accident.

The court also learned that Tolan’s phone was connected to his car’s Bluetooth system, yet records showed recent phone usage just seconds before the crash. Judge Richardson criticized Tolan’s arrogance and lack of empathy during police interviews, where he attempted to shift blame onto the deceased, the DVLA, and his optician.

“You are responsible for the demise of a vibrant 29-year-old woman with a promising future ahead. You obliterated that future,” remarked Judge Richardson. Tolan went as far as blaming Ms. Smart posthumously, alleging that she darted in front of his vehicle without giving him a chance to react.
